It is our intention to see to it Riddhi Desai (Texas Bar license #05656775) is disbarred for her actions and sued for the $139,000 in money damages (so far) she has caused (which is only a portion of the actual damages - it will cost approximately $250,000 - $300,000 to replace Sophia's and my home with something equivalent to what we had and with the equity we would have had, to re-purchase the material possessions we have lost, and to restore our credit rating to the 720+ level it was before this attack). We will also seek punitive damages appropriate to her racial and gender hatred that caused her to attack a man's family and home. We intend to see Shilpi Desai criminally prosecuted for identity theft and fraud. In the meantime, I have a duty to inform possible past victims and protect potential future victims of their conduct and tendencies towards bigotry, hatred, and dishonesty.

Note: Jennifer Chih-Chieh Reynolds (Texas Bar license #00798461) partners and shares office space with Riddhi P. Desai. They tag-team a lot of cases, including the divorce case where Shilpi P. Desai (Riddhi Desai's daughter) was caught red-handed stealing and committing fraud with a respondent's identity. We do not have any direct evidence regarding Ms. Reynolds' involvement in identity theft or fraud, but we have no evidence to disprove it, either. Ms. Reynolds certainly has not acknowledged or condemned the illegal behaviors, nor denied she had any role in them. However, even in the event she did not directly participate in the identity theft and fraud, we know that Riddhi Desai has exchanged case information with her and there is no reason to believe she has acted in any manner to restrict Riddhi Desai or Shilpi Desai's access to materials in offices they share (or that Riddhi or Shilpi Desai would not circumvent any restrictions if she did). Regardless of her direct involvment (if any), Jennifer Chih-Chieh Reynolds will be called to the stand for her testimony regarding what she knows about the identity theft and fraud and/or the circumstances and history surrounding those crimes.

I got a call from an investigator with the Houston Police Department this morning. We had quite a conversation about Riddhi Desai and Shilpi Desai, and about the criminal complaints I filed against Ramone Naturell for a death threat and vehicular assault in May, 2011.

The detective was calling because Riddhi Desai was upset that this website was exposing Desai's daughter, Shilpi P. Desai, for the identity theft she had committed and for using six different social security numbers. Of course, pointing out someone's criminal behaviors and other suspicious activities is perfectly legal - in fact, it is something various police organizations recommend and applaud (think Neighborhood Watch). But Riddhi Desai is not an honest person, and so she filed a police complaint with the Houston Police Department.

Riddhi Desai's formative years and development environment

If you are not a well-traveled person, you may not fully appreciate the general nature of an East Indian's interactions with government officials. You would first need to understand that India is even now one of the most corrupt countries on Earth (before a decade or so ago, it was far and away the most corrupt nation) , and the citizens have for decades been known as those most likely to offer bribes to or to solicit bribes from persons in and out of positions of authority. [I find it fascinating that the same tool I am using to fend off those who abuse power over her to hurt Sophia, the Internet, is one of the tools that Riddhi Desai's countrymen are also using to fight corruption and abuse of power - and that Riddhi Desai is so fearful of it.] Secondly, India has, since independence, been primarily a Soviet satellite state, a pretending socialist democracy whose bureaucrats and civil servants come right out of the USSR mold - incompetent, corrupt, and abusive. Finally, Indians have for centuries been among the most prejudicial peoples on the planet, so much so that when mere racism, religious bias,and ethnic bigotry wasn't satisfying enough, they formalized their discrimination with the arrangement Westerners know as the caste system thousands of years ago. While Indians might state that officially the caste system has been abandoned, even today the degree to which it is a part of daily Indian life would astonish and horrify most Westerners, especially when it comes to economic privileges like property ownership. Foreigners to India (for eaxample, US citizens like us) are beneath the lowest caste: "Theoretically, all foreigners are considered to be casteless and hence outcast; meaning that Hindu, especially the orthodox upper caste families, would not touch or invite them to their homes" (from http://en.wikipedia.org/wiki/Caste_system_in_India).

As to plying her trade, in India a day in the life of a practicing attorney is that of a street hustler and paper pusher. Much of a successful corporate attorney's income there is derived from skimming bribes and fees for arranging relationships between companies and government agencies outside of public view. Here is an anecdotal account of what I'm told is a fairly typical experience with an Indian lawyer in India (from an Indian emigre source).

In short, there are reasons India is considered a third-world country, and why you should be very cautious with anyone who spent their formative years in that kind of an environment. Just as the circumstances of your own childhood influence everything you have done or will do throughout your entire life, so the ignorance, barbarity and discrimination in all things about her growing years courses through Riddhi Desai's thoughts and actions, and will until the day she passes on. It is in her bones, and cannot be cured.

So this is the background Riddhi Desai brings to the table in her primary trade as an abuser of the broken US immigration system - an attitude that government officials (including judges) are beneath her and objects to be manipulated to attain her goals. These are the values she's (rather obviously at this point) passed down to her own daughter.

Fortunately not all East Indians are like Riddhi or Shilpi Desai

Having said all of that, let me also say it has been my privilege and pleasure to work alongside some of the finest minds in oilfield and computer engineering in my 28 years as a software engineer, many from Pakistan and India. I don't believe any of my friends from that part of the world would take offense at my rendering above of what they know to be truths about their native lands. After all, they've chosen to be here, raise families here, and own property here rather than there for a reason. And because of the quota system applied to work-related visas for immigrants from India, we normally see only the very best and brightest in the technical disciplines who make it through all of the (often unfair) filters - these people are well aware of the world around them and the choices available to them. This may be the mechanism by which Pankaj Desai (Riddhi Desai's husband, Shilpi Desai's father) first arrived here. Certainly Riddhi Desai bypassed any of those filters. Given that Ridhhi Desai possesses no qualities of skills the US government would find desirable for a work-related visa and her character doesn't match the standards of other visa recipients I know, I assume she arrived here riding the coattails of her relationship with Pankaj Desai, and that both have remained here by using Shilpi Desai as their "anchor baby."

The circumstances of the HPD complaint

It should be apparent already that neither Riddhi Desai nor Shilpi Desai have an honest bone in their body, but if should you have any doubts, you need only to consider the circumstances surrounding the HPD complaint. To begin with, Shilpi Desai (the offended party Riddhi Desai purported to be representing) lives in Sugar Land. Even though the law requires filing the complaint in Sugar Land, and despite being told this by the investigating officer, Riddhi Desai insisted on filing the complaint in the wrong jurisdiction - Houston (by claiming her own office address in Houston as her daughter's residence specifically for the purpose of this complaint). Why? Because Riddhi Desai is about to be held accountable for her crimes in a Harris County court (Houston is in Harris county, Sugar Land is in Fort Bend County). She will stand accused in a the civil case where I am seeking full (sole) custody of my daughter Sophia from my ex-wife, a case where Sophia's loss of her home because of Shilpi and Riddhi Desai's crimes will be discussed at great length. Sophia and I will be seeking sanctions and compensation for the Desai's behavior, as well as removal of them and their law or business associates from involvement in this case.

Riddhi Desai would like to get ahead of this and try to paint herself as the "victim" (her normal client scam in immigration cases), but what she doesn't know is that there have already been several discussions among a variety of people about this situation. Staging a complaint in a jurisdiction she as a lawyer knows is inappropriate simply to manipulate the Court is not going to be well-received by the Court. She had already filed a motion when the case was in Fort Bend County alleging that my publishing of her and her daughter's crimes would affect her client's ability to get adequate representation (most attorneys snicker at her transparency when they read the motion). She then abandoned the mtion, but did not act to have it immediately dismissed, once she learned I had her daughter dead to rights regarding the Fluor Corporation IP address Shilpi Desai used to perform the identity theft. The filing of that request may prove to be the clearest proof yet Riddhi Desai is not a deep thinker - the act extended any statute of limitations for identity-theft-based civil actions against Riddhi Desai and Shilpi Desai by the length of the time period between the motion filing and the date the motion was finally dismissed, which because no hearing date was set didn't happen until August 15, 2011.

By the way, do you think it has occurred to either Riddhi Desai or Shilpi Desai that the most effective way to avoid being accused of identity theft is not to steal someone's identity in the first place?

So the primary intent of filing a police complaint in the wrong jurisdiction was to put an implausible spin on her and her daughter's crimes for the Court's benefit. Her second goal was to intimidate me. Do I seem intimidated to you (smile)? I'd be lying if I didn't admit I do get some sense of satisfaction at the justice in seeing her squirm as a result of her own evil designs (but hey, if two thieving gender-bigots had stolen your baby daughter's home, you'd allow yourself the same small pleasure).

As it turns out, free speech is still legal in this country

Let me stop for a moment and address something you may not know (and Riddhi Desai would prefer you didn't know) about free speech. Obviously, you can't just go around saying something bad about someone just because you're mad at them, particularly if it is hurtful to their opportunities or finances. However, you can certainly (and loudly) describe things you've witnessed with your own eyes (as I have Shilpi Desai's theft of my identity) or those things where it is reasonable to believe something observed or experienced by someone else. The latter case pertains to Shilpi Desai's abuse of multiple Social Security numbers. As described previously, Riddhi Desai's bulb doesn't burn all that brightly, so it is hard to know sometimes whether something she doesn't say is meant to be deceptive, or is just born of sheeer stupidity. In any case, she failed to mention to the investigator that if you clicked the line above that reads "Click here to see the most recent background investigation on Shilpi P. Desai", you are taken to an unaltered copy of a professional Internet background investigation performed by one of the most respected agencies in the country. It was that private investigator who discovered, using only publicly-available information found on-line, that Shilpi P. Desai had used at least six Social Security numbers (an illegal act in and of itself separate and apart from the theft of my identity). So, given both my personal observation of Shipli Desai's criminal conduct and the professional investigator's discovery of additional potentially criminal behavior, I have every right to rely on that information to form and announce an opinion of Shilpi Desai's character and conduct on this or any other website. This would be true even if I had not published the report on which I based my opinion (as long as it actually existed). Our country's founders enshrined freedom of speech in the constitution for exactly the purpose for which I am using it here - to keep bullies, tyrants, government officials, and other abusers of authority (including officers of the Court, otherwise known as lawyers) from taking away our inalienable rights (such as father's right to provide a home and love to his five-year-old daughter).

Judicial manipulation

The third, and most important, reason Riddhi Desai wasted HPD's time filing a complaint that was not only baseless but out-of-jurisdiction has to do with her cynical Indian attitudes towards public servants. She believes that by filing the complaint in Harris County, she will attract the attention of the judge that will hear my child custody case, and that judge, a fellow lawyer, will be so overwhelmed with the need to exact revenge on her behalf that he or she will violate judicial ethics, and the law, and all decency and take Sophia away from the only parent loving, and providing for, her.

In other words, Riddhi Desai is anticipating that because I dared to exercise my freedom of speech in a website against a lawyer who shares a license to practice law with a judge, that judge will have a desire, and will act on that desire, to destroy my five-year-old daughter and me as a political act of repression, similar to what you might expect in a Soviet-era Iron Curtain country, or in Hitler's Germany. Yes, I know that's nuts - but she truly believes this. That is the way Riddhi Desai thinks... you'd just have to meet this witch to understand her. In her world, it is perfectly rational that a male, because he is a lower form of life anyway, would have to pre-emptively and voluntarily surrender his freedom of speech (among other freedoms), and would have to bow before her and her female client, before the system should ever even consider any petition I might advance. That is, after all, how untouchables have been treated for centuries in India.

And truthfully, there is some reason to worry. Certainly Texas has its share of judges who think they are above the law, or that their election is a mandate to abuse anyone who doesn't thump the same Bible they do. Gender bigotry is rampant in many forms in the family court system, even though a strict reading of the law doesn't allow it. And as Sandra Day O'Connor has so eloquently pointed out, an elected judiciary is inherently corrupt and manifestly an exercise in mob rule. In a race for judge, winning a popularity contest trumps judicial merit - while a popular candidate who is not a good judge can be elected, a candidate who is a good judge but not popular cannot. Of course, there are always plenty of lawyers to buy your favors, er, contribute to your election campaign, and pity their chances before the bench if they don't pay their dues (so to speak). Finally, there's the Texas Bar Association - world-famous as a kind of cross between the Ku Klux Klan and a carnival barker - where disciplinary proceedings are secretive, rarely made known to the public, and by design always results in greater pain to non-members than members, like any good klaven, even as the officers loudly clamor for any means available to make a lawyer another buck.

All that having been said, I do believe in the system (under the premise of "trust, but verify"). I think, in most cases, people who put on the robes do step up a level and rise to the task. I also know that, like all elected officials, judges are answerable to their constituents, and that that any constraints ordinarily placed on free speech are loosened significantly when publicly describing the actions and words of an elected public servant (especially during an election cycle). In other words, you are given much more freedom to express your opinions about someone running for office - well-suited to media like the Internet. Beyond that, I know the facts in my child-custody case are so overwhelmingly in Sophia's and my favor that any whiff of judicial prejudice, discrimination, revenge, or favoritism will be glaringly evident, especially given the well-documented history of this case.

Finally (with respect to judges improperly adjudicating according to personal prejudice), I know that we've already had one judge recused for discriminatory misbehavior in this case (Judge Ronald R. Pope,  328th District Court, Fort Bend County). In fact, Riddhi Desai, who isn't particularly bright or creative, has drawn on the failures of Judge Pope for her own tactics - criminality by proxy family member (Judge Pope used his wife to claim an assault that never happened; Riddhi Desai used her daughter Shilpi Desai to commit identity theft) and filing a false or frivolous police report. Hmmm, odd they would be using the same methods...

New felony charges against Shilpi Desai

Getting back to my conversation with the investigator, Riddhi Desai's gamesmanship with the Houston Police Department may cost her and Shipli Desai dearly. Police officers have more important things to do than to be "played" by unscrupulous attorneys, and do not appreciate having wasted their time once they've been told the full story. In this case, the detective felt compelled to inform me that Shilpi Desai's abuse of multiple Social Security numbers is a significant crime in and of itself, and depending on the nature and severity of the harm she caused, quite probably a felony (I had considered all of this an extension of her original identity theft against me, and hadn't realized each instance of Social Security number fraud is a separate chargeable offense). He suggested I file a complaint with the Sugar Land police department (the rightful jurisdiction) providing them the background investigation report and explaining to them that Riddhi Desai had attempted an end-around by filing a complaint with the Houston Police Department. I have made an appointment to do just that. However, I since learned that there are federal laws (Homeland Security) against illegal or inappropriate use of Social Security numbers, and by the time you read this I will have filed a complaint with the U.S. government (including an additional letter to immigration authorities).

Other communication channels

It is interesting to me that it was the information posted on this website that provoked such a negative and inappropriate reaction from Riddhi Desai. While the extent of Riddhi Desai's cluelessness no longer surprises me, surely she should realize that the forces which will extract justice in this situation won't come from broadcasts to the general public, but from direct communications among and between networks of people much closer to her home, her husband, and her daughter. The fact that Riddhi Desai's husband Pankaj Desai doesn't seem to wear the pants in his own family is one thing - who knows why God distributed more rectums and fewer backbones among certain types of people? But the oilfield and oilfield services communities, though large, are relatively close-knit, and among the professionals and executives who work for them there is an expected esprit-de-corps. That as a licensing manager for Shell Oil Pankaj Desai would allow his wife and daughter to attack fellow members of this elite group (including me) for occupational profit is bad enough; that he would allow his wife and daughter to use underhanded and criminal tactics is unacceptable to all of us. The Desais should be aware that there is a back-channel conversation going on within these communities (including the Shell and ERM management teams) about the Desai family and their abuse of industry colleagues, and that conversation is likely to affect Pandaj Desai's and Shilpi Desais' opportunities and careers going forward. Rightly or wrongly, there is a respect for, and an expectation of, a certain level of manhood that comes from the wildcatting origins of the industry, and the concept includes managing and taking responsibility for the conduct of one's family. Beyond that, everyone in these discussions understands clearly, especially the non-East Indians, that it could just as easily have been them or their children that Riddhi and Shilpi Desai went after, or that they or someone they know might be the targets of Riddhi Desai's next temper tantrum.

For someone who has a husband and a child, you would think that breaking the law and using other extreme measures to go after another's family would fall into the general category of "those who live in glass houses should not throw stones" - but I don't know that Riddhi Desai is evolved enough intellectually to think forward to the possible consequences of her actions. Riddhi Desai seems like a rote thinker - someone who cannot visualize anything beyond what someone else has shown her or that which she's seen before (some members of certain cultures are so hung up on the immediate grab of money or advantage they lose sight of all else).

Resolutions (double-entendre intended)

In any case, I am looking forward to the final resolution of Sophia's child custody case. It is unfortunate that Riddhi Desai has no class whatsoever - had she any, she would acknowledge her and her daughter's bad acts, apologize profusely and sincerely, and have her attorney contact my attorney to work out the means by which she is going to replace Sophia's home and property. That's what grownups are supposed to do in situations like this, and there is no other means by which this is going to be resolved. But that is not going to happen (the Desai's are not rocket scientists, either) so after Sophia's case is heard I will turn my full attentions to finding inventive ways to ensure Riddhi and Shilpi Desai are fully held to account for their misdeeds. I'm pretty good at creative problem solving (a word of advice: never screw with an honest man's family!)... One of the more adventurous thoughts that occurred to me is that you can generate a pretty visible and active discussion of someone's character flaws across a variety of media forms by running them as a write-in candidate for public office. You don't need their permission to enter the contest, and all the rules of electioneering (including enhanced freedoms of speech) come into play.

Just curiosity, but...

Finally, for anyone considering hiring Riddhi Desai as their attorney and irrespective of how you may feel about the various facts of this matter, do you really want someone representing you who was dumb enough to have placed themselves into this situation in the first place?

Mercenary, manipulative, and man-hating (poor Pankaj!), this cold-hearted professional liar is more Yi Jian's pimp than her lawyer. Had Yi Jian not already lived life as a prostitute in China, Riddhi Desai would have suggested the occupation to her as a means to pay her attorney...none other than Riddhi Desai, of course.

Riddhi has never had a conversation with another attorney, a pleading, a mediation, or any other communication in this case that did not include as its first component her compensation. She's never missed an opportunity to complain that she's not being paid by her client. So how did a woman with such an eagle-eye for the bottom line get herself into such a position?

She was betrayed by her own greed. When Lawrence Victor Bush was facing sanctions, possibly even disbarment, for his ethics violations representing Yi Jian during the first six months of the kidnapping, he and the law firm he worked for saw Riddhi Desai as a way out of their dilemma. They simply told her they had a case about to go to trial involving a young baby, an accusation of abuse, a petite Chinese woman and her daughter stranded and abandoned in the United States with nowhere to turn. Riddhi Desai filled in the missing details with her own gold-embossed imagination.

Here stood a chance to make a quick profit using her usual tricks - hiding exculpatory evidence and other information, playing on "mommy factor", using her extensive knowledge of abusing the immigration system to temporarily bandaid Yi Jian's status, stick it to the man in the picture, and when all else fails, lie. Unfortunately, in her speed to greed she neglected to ask the notably dishonest Bush why he was giving up this plum situation to her (or if she did, she didn't bother to check on his answer). Too cheap to spend the money for a translator, she didn't check up on her client's story and took Jiao Jiao's imaginative stories as fact. When she became aware of the website at www.jiaojiaozhang.com, she dismissed it as the ravings of a crazed man (after all, all men are stupid, crude, and hormonal, right?), and actually believed the information there would work to her advantage. She made no effort to learn why the judge in the case had to recuse himself. She welcomed this case as quick in-and-out exploiting of the pro-female bigotry latent in the court system and with which she was very familiar.

Refusing to work with my attorney, she brought little to court other than a viciously mean attitude towards men - she spent much of her idle time actually glaring at me and my attorney - and a raft of tired anti-male cliches. She had prepped her clients with some standard story-padding commonly used by victims in abuse cases to amplify their empathy, without reading the police report or recognizing that no abuse had ever occurred against her client - all the abuse in the case was perpetrated by her client on others - or checking the timelines. She didn't seem to know that because of the political corruption surrounding this case, every law enfocement agency in Texas, including the Texas Rangers, had pored over the facts of this case in the seven months prior to trial.

The results speak for themselves - see the complete temporary orders transcript. The kidnapping that Riddhi Desai was attempting to not only exploit, but extend, was terminated immediately, and I was given exactly what the law demands: equal time and access to the daughter I hadn't seen in peace since her birth. Quite probably the most pathetic scene I've witnessed in a courtroom was her arrogant appeal, after having been exposed for her lies and manipulations, to have her legal fees paid by us (more accurately, from my daughter's college fund since at this point I had been driven into bankruptcy).

This is not a unique happenstance in Riddhi Desai's career. The Internet records a recent case where Riddhi's transparent greed so incensed a jury in a civil trial that they awarded the opposing party punitive damages even though the injured party hadn't suffered any actual money damages - see Marvis Ekhator Odia, D/B/A Odia Motors, v. Oscar Lopez and Flor Lopez. Because under Texas law, you must suffer actual damages in order to receive punitive damages, the decision was reversed on a technicality, but it's apparent juries are able to see through Riddhi Desai's manipulations.

The Odia case also exposes Riddhi Desai's racism and two-faced nature. Riddhi Desai has been quoted in various pages on the Internet spouting a lot of altruistic pablum about championing the needs of the "poor and downtrodden". Of course, the "poor and downtrodden" happen to be those caught abusing the immigration system and hardened criminals. Listen to this classic Riddhi Desai quote (note the emphasis on money):

"The people we represent come from a poorer background," says attorney Riddhi Desai. "Probation is expensive. There's the $140 supervision fee. The fines to be paid off. The random urinalysis they must undergo almost every month; they must pay for that." Costs usually average out to $100 a month, she says.

"These are people who do not have $200 to get out of jail on bond," she says. "And people don't want to be in jail. Once in the probation system, they are at the mercy of the probation officer who supervises them, the people who do the drug testing and the judge. Any one person complaining about them could wipe out all they've tried to do and start them back up."

And who do you think she's talking about? Felons busted for selling and using crack cocaine! Uhhhh, Riddhi...if people don't want to be in jail, and endure these horrific insults to their dignity, why don't they just quit committing crimes???

But even if you have a very active imagination and can picture Riddhi Desai as some kind of beady-eyed Mother Theresa protecting the poor of the world, you should know her sympathies revert dramatically as soon as one of her Pakistani countrymen is involved in a situation involving those same poor people. Odia Motors is a greasy used-car dealership that preys on those very people who need protection...but of course, in Riddhi Desai's opinion, Hispanics and Caucasian males are lower forms of life that don't really count.

Lawyers are officers of the Court. As such, they are bound by oath and ethics to preserve and protect confidential information that becomes the property of the Court as evidence or testimony. The most egregious offense a lawyer can commit, just shy of murder, is to commit identity theft upon a party to a matter before the Court, and as an act of vengeance attempt to destroy the individual, his family, their livelihood, and/or their property by disseminating it to criminals and those not entitled to have it. Riddhi Desai and Shilpi Desai  did exactly that.

It is our intention to see to it Riddhi Desai is disbarred for her actions and sued for the $139,000 in actual damages (so far) she has caused as well as punitive damages appropriate to her racial and gender hatred that caused her to attack a man's family and home. We intend to see Shilpi Desai criminally prosecuted for identity theft and fraud. In the meantime, I have a duty to inform possible past victims and protect potential future victims of their conduct and tendencies towards bigotry, hatred, and dishonesty.
